S. 4040 — Dakota Water Resources Act Amendments of 2026

This section authorizes additional appropriations, as indexed for construction cost fluctuations, for Bureau of Reclamation municipal, rural, and industrial (MR&I) water supply projects in North Dakota under section 7(a), including (1) $120 million for the Northwest Area Water Supply Biota Water Treatment Plant and Pump Station Project; (2) $404 million for the McClusky Canal and Missouri River North Alternative of the Eastern North Dakota Alternate Water Supply Project; (3) $50 million for specified components of the Southwest Pipeline Project; and (4) $63 million for North Dakota rural water districts' water treatment and distribution expansions (allows transfers among these projects limited to a 50% increase per project and use of funds for final engineering reports due within two years of enactment). The section further authorizes $743 million, as indexed, under section 7(d) allocated as follows: (1) up to $118 million to complete the Spirit Lake Rural Water System on the Fort Totten Indian Reservation; (2) up to $275 million to complete the Three Affiliated Tribes Rural Water System on the Fort Berthold Indian Reservation; (3) up to $240 million to complete the Standing Rock Rural Water System on the Standing Rock Indian Reservation; (4) up to $98 million to complete the Turtle Mountain Rural Water System on the Turtle Mountain Indian Reservation; and (5) $12 million for a feasibility study and initial construction of a new MR&I system for the Lake Traverse Indian Reservation (allows use of funds for final engineering reports due within two years of enactment). This section increases the authorization under subsection (c)(2)(B) to $75 million for section 11 projects and revises subsection (e) to index specified base amounts of $200 million each under subsections (a)(1)(B) and (b)(1)(B), plus prior funds under subsection (b)(2)(A) and (B), for construction cost changes since enactment of the Dakota Water Resources Act of 2000.
