S. 405 — Protection of Women in Olympic and Amateur Sports Act

This section adds definitions to the Amateur Sports Act for "female" (i.e., an individual with, or who had, will have, or would have but for a developmental or genetic anomaly or historical accident, a reproductive system that produces, transports, and utilizes eggs for fertilization), "male" (i.e., similar definition for a reproductive system that produces, transports, and utilizes sperm for fertilization), and "sex" (i.e., an individual's biological sex, either male or female); and revises national governing body (NGB) eligibility requirements to include a prohibition on males participating in amateur athletic competitions designated for females, women, or girls. (Thus, NGBs—which oversee specific sports for the U.S. Olympic and Paralympic Committee—must enforce this sex-based eligibility rule to obtain or maintain certification.)
