S. 4059 — End-of-Year Fiscal Responsibility Act

This section defines three terms for purposes of the Act: (1) "covered period" as the 2-month period immediately preceding the end of a fiscal year; (2) "discretionary appropriations" as having the meaning given that term in section 250(c) of the Balanced Budget and Emergency Deficit Control Act of 1985 (2 U.S.C. 900(c)); and (3) "executive agency" as having the meaning given that term in section 105 of title 5, United States Code.

This section establishes limits on Executive agency obligations of discretionary appropriations during each month of a covered period at the end of a fiscal year, prohibiting such obligations from exceeding the agency's average monthly obligations during the preceding 10-month period (with exceptions for national security-related activities and disaster relief efforts). The section also requires each Executive agency to submit to Congress and post on a publicly available website, not later than 60 days after the end of each fiscal year, an itemized list of discretionary appropriations obligated during the immediately preceding covered period.
