This section revises the President's authority to waive the prohibition on constructing vessels for the armed forces, or major components of their hulls or superstructures, in foreign shipyards by— (1) limiting such waivers to shipyards located in a North Atlantic Treaty Organization (NATO) member country or an Indo-Pacific country that is party to a mutual defense treaty with the United States, where the construction cost is less than it would be in a U.S. shipyard; and (2) requiring the Secretary of the Navy to certify to Congress, prior to commencement of construction of a naval vessel or major hull or superstructure component at such a shipyard, that the shipyard is not owned or operated by a Chinese company or a multinational company domiciled in the People's Republic of China. The section also updates the cross-reference in subsection (a) from "subsection (b)" to "subsections (b) and (c)" to explicitly include the existing exception for inflatable boats.
