S. 4065 — STAND with Taiwan Act of 2026

This section defines a "covered determination" as either (1) a presidential determination under subsection (b) that specified China-related actors have engaged in, are engaging in, or imminently plan aggressive acts against Taiwan; or (2) enactment of a congressional joint resolution making such a determination under subsection (c). It requires the President to make the initial determination not later than 15 days after enactment of the Act and every 30 days thereafter as to whether the following actors have committed such acts: (1) the government of the People's Republic of China; (2) the Chinese Communist Party; (3) any proxy thereof; (4) any individual or entity controlled by or acting at the direction thereof; (5) any individual on a top PRC decision-making body; or (6) any person described in §§102 or 103. The acts include overthrowing or dismantling Taiwan's governing institutions; occupying territory controlled or administered by Taiwan as of enactment; violating Taiwan's territorial integrity; or taking actions such as creating a naval or aerial blockade, seizing offshore islands, initiating military attacks (including amphibious landings, air assaults, aerial bombardment, missile attacks, or naval bombardment), or conducting a debilitating attack on Taiwan's critical infrastructure. It establishes expedited procedures for "covered joint resolutions" (with prescribed text making the determination), which may be introduced only by House or Senate party leaders or designees and receive: (1) automatic committee discharge after two calendar days; (2) waiver of points of order; (3) no amendments; (4) debate limited to four hours in the House (equally divided) and 10 hours in the Senate (equally divided between leaders or designees); and (5) a vote on final passage without intervening motions.

This section requires the President, not later than 3 days after a covered determination, to (1) impose sanctions described in section 201 on specified persons to the extent identifiable and (2) prohibit any U.S. person (except U.S. government officials acting in an official capacity) from engaging in transactions with those persons. The persons subject to sanctions include (1) senior officials of the People's Republic of China (PRC) government and Chinese Communist Party (CCP), such as the General Secretary, Standing Committee members of the National People's Congress, President, Vice President, State Council leaders and members (including all ministers), Minister of National Defense, Central Military Commission members, commanders of People's Liberation Army (PLA) branches and forces, and directors/ministers of key commissions and agencies (e.g., National Development and Reform Commission, Agriculture and Rural Affairs, State Security, Public Security), plus any other officials so designated by the President and certain foreign persons in those roles; (2) foreign persons who knowingly sell defense articles or conduct transactions with PRC armed forces (except official foreign government transactions), undermine Taiwan's military readiness or democratic processes or commit human rights abuses there (e.g., enforced disappearances, torture), or engage in transnational corruption, assassination of U.S. persons or allies, threats to U.S. or allied security, or sanctions evasion; and (3) agents or others receiving property transfers from sanctioned persons to evade sanctions.

This section directs the Secretary of the Treasury, not later than 3 days after a covered determination, to (1) impose blocking sanctions under the International Emergency Economic Powers Act (without requiring a national emergency declaration) and correspondent/payable-through account restrictions on the People's Bank of China, state-owned banks (e.g., Industrial and Commercial Bank of China, Bank of China), other financial institutions organized under PRC laws and owned wholly or partly by the PRC government, their subsidiaries and successors, and any financial institution transacting with them; (2) impose sanctions described in section 201 on their directors, officers, officials, and shareholders with an interest; and (3) prohibit U.S. persons from transacting with them. (Thus, these measures sever the targeted institutions from the U.S. financial system.)

This section directs the Secretary of the Treasury, not later than 3 days after a covered determination is made, to impose the sanctions described in section 201(1) on any entity engaged in commercial activities on behalf of the Government of the People's Republic of China or the Chinese Communist Party in which the government or party has an ownership stake and exercises ultimate control over business decisions.

This section prohibits depository institutions (as defined in section 19(b)(1)(A) of the Federal Reserve Act) and brokers or dealers registered with the SEC, not later than three days after a covered determination, from processing fund transfers to or from the People's Republic of China or for the direct or indirect benefit of officials of the PRC government or members of the Chinese Communist Party. An exception applies to transfers arising from, and ordinarily incident and necessary to give effect to, an underlying transaction authorized by a specific or general license, provided the transfer does not involve debiting or crediting a Chinese account.

This section directs the Securities and Exchange Commission to prohibit securities of issuers listed with the China Securities Regulatory Commission from being traded on a national securities exchange (i.e., an exchange registered under the Securities Exchange Act of 1934) on and after the date that is three days after a covered determination.

This section directs the Secretary of the Treasury, not later than three days after a covered determination is made, to prohibit any U.S. financial institution from making monetary investments (1) to an entity owned or controlled by the Government of the People's Republic of China (PRC), the Chinese Communist Party (CCP), or the People's Liberation Army (PLA); or (2) for the benefit of any priority industrial sector identified in the PRC's "Made in China 2025" plan or "14th Five Year Smart Manufacturing Development Plan" (i.e., PRC initiatives to achieve global dominance in advanced manufacturing and technology), including agriculture machinery; information technology; artificial intelligence, machine learning, and robotics; green energy and green vehicles; aerospace equipment; ocean engineering and high-tech ships; railway equipment; power equipment; new materials; medicine and medical devices; fifth-generation and future telecommunications; semiconductor manufacturing; biotechnology; quantum computing; surveillance technologies (including facial recognition and censorship software); fiber optic cables; and mining and resource development. U.S. financial institution means any financial institution that is a U.S. person and includes an investment company, private equity company, venture capital company, or hedge fund that is a U.S. person.

This section prohibits, effective three days after a covered determination, (1) the export, reexport, or in-country transfer to the People's Republic of China (PRC) of any U.S.-produced energy or energy product, as directed by the Secretary of Commerce under the Export Control Reform Act of 2018; and (2) investments in the PRC energy sector by U.S. persons. The section further directs the President to impose sanctions under section 201 of the bill on foreign persons who knowingly facilitate the production of oil, uranium, natural gas, petroleum, petroleum products, or petrochemicals for use by persons sanctioned under sections 102, 103, or 104 of the bill, and to prohibit U.S. persons from transacting with such foreign persons.

This section prohibits any United States person from purchasing sovereign debt of the Government of the People's Republic of China on and after the date that is three days after a covered determination is made.

This section requires the President, not later than 3 days after a covered determination, to impose sanctions under the International Emergency Economic Powers Act on (1) any global financial communications services provider that does not terminate financial communications services to, and access facilitation for, financial institutions sanctioned under section 103 or other provisions of this Act; and (2) such provider's directors, officers, and shareholders with an interest in the provider.

This section requires the President, not later than 15 days after a covered determination, to increase the rate of duty on all goods imported from the People's Republic of China to up to 500% ad valorem, notwithstanding any other provision of law. The increased duty rate applies in addition to any antidumping or countervailing duties.

This section requires the President, not later than 15 days after a covered determination is made and every 90 days thereafter, to increase the rate of duty on all goods imported into the United States from specified countries to up to 500 percent ad valorem (in addition to any antidumping or countervailing duties under the Tariff Act of 1930). Specified countries include those that knowingly (1) sell, supply, transfer, or purchase oil, uranium, natural gas, petroleum products, or petrochemical products to or from the People's Republic of China (PRC); or (2) sell, supply, transfer, or purchase products, materials, or financial support to or from the PRC for its military-industrial capacity (i.e., capacity to produce and supply equipment, technology, weapons, training, personnel, manpower, and systems for military operations) or for acts described in section 101(b)(2). This section prohibits waivers of these duties for countries determined to be state sponsors of terrorism under authorities including 22 U.S.C. 2371 (which prohibits U.S. assistance to such countries) or listed in 10 U.S.C. 4872(f)(2).

This section establishes sanctions applicable to sanctioned persons, as follows: (1) blocking all property and interests in property in the United States, coming within the United States, or in the possession or control of a U.S. person, using all powers granted by the International Emergency Economic Powers Act (IEEPA) without requiring a national emergency declaration; and (2) for aliens, ineligibility for U.S. visas, admission, parole, or other benefits under the Immigration and Nationality Act (INA), with immediate revocation of any current visas or entry documentation (automatically canceling any other valid visas in the alien's possession).

This section authorizes the President to waive sanctions, prohibitions, restrictions, duties, and penalties under this Act with respect to a person—except as provided by section 112(d)—for successive periods of not more than 90 days each, if the President determines for each period that the waiver is in the national security interests of the United States, supports the enduring security of Taiwan and a return to the disposition of forces that prevailed before the act that led to the applicable covered determination, and notifies the appropriate congressional committees with the reasons for the waiver.

This section provides exceptions to the Act's applicability or sanctions requirements in four cases: (1) efforts to promote democracy in the People's Republic of China; (2) activities subject to reporting under title V of the National Security Act of 1947 (50 U.S.C. 3091 et seq.) or authorized U.S. intelligence activities; (3) admission of an alien necessary to comply with U.S. obligations under the UN Headquarters Agreement of 1947, the Vienna Convention on Consular Relations of 1963, or other international agreements; and (4) imposition of sanctions on the importation of goods (i.e., any article, natural or manmade substance, material, supply, or manufactured product, excluding technical data).

This section authorizes the President to exercise all authorities under sections 203 and 205 of the International Emergency Economic Powers Act (IEEPA) (i.e., powers to investigate, regulate, or prohibit foreign exchange transactions and transfers of credit; block, confiscate, or otherwise control property in which foreign countries or nationals have an interest; and require recordkeeping and reporting) to implement this Act, excluding sections 111 and 112. The section applies civil and criminal penalties under IEEPA section 206(b) and (c)—greater than $300,000 (adjusted for inflation) or twice the transaction value for civil violations, and fines up to $1 million and imprisonment up to 20 years for criminal violations—to persons who violate, attempt to violate, conspire to violate, or cause a violation of this Act or related regulations, licenses, or orders, excluding sections 111 and 112.

This section authorizes the President to terminate sanctions, prohibitions, restrictions, duties, and penalties under this Act upon submitting to Congress a certification that (1) all actors described in section 101(b)(1) have verifiably ceased acts described in section 101(b)(2), and (2) the Government of the People's Republic of China and the Chinese Communist Party have renounced such acts in the future. The section further requires the President to immediately reimpose all previously terminated measures—plus new ones—if any such actor engages in any such act thereafter.
