S. 4069 — AI-Ready Bio-Data Standards Act

This section directs the Director of the National Institute of Standards and Technology (NIST), not later than two years after enactment, to establish definitions, standards, data management resources, and cybersecurity frameworks—pursuant to advisory group recommendations and public feedback—to ensure biological datasets generated from qualified federally funded research are artificial intelligence-ready (i.e., generated and formatted to enable effective use in training artificial intelligence models and to support advancements in artificial intelligence and biotechnology research). The required definitions cover (1) artificial intelligence-ready, (2) biomanufacturing, (3) biotechnology, and (4) qualified federally funded research, with the latter based on conditions such as federal funding amount awarded, recipient capability and expertise in producing artificial intelligence-ready datasets (including negative data), dataset size, and other factors deemed appropriate by the Director; the Director may deem an otherwise qualifying dataset not artificial intelligence-ready in consultation with the relevant federal agency's Chief Data Officer. The section further requires NIST to (1) ensure these elements are not overly burdensome on recipients, (2) test and evaluate them in consultation with federal agencies, private sector entities, and biotechnology researchers, (3) update them annually beginning one year after establishment if appropriate, and (4) consult specified biotechnology and artificial intelligence industry representatives, academia, and agency heads (Agriculture, Defense, Energy, NASA, NIH, NSF, and others) while hiring necessary staff. Additionally, not later than one year after enactment, the Director must inventory existing biotechnology standards used by federally funded recipients and existing biological datasets generated from such research.
