S. 4105 — Naturalization Accountability Act

This section expands grounds for revocation of naturalization under INA Section 340(c) by (1) eliminating the requirement that a naturalized citizen become a member of a Communist organization, totalitarian organization, or organization described in INA Section 313 within five years following naturalization (changing from "shall within five years next following such naturalization become" to "becomes," thus applying to membership at any time); and (2) adding as a ground conviction of any felony at any time (inserting the language after the reference to INA Section 313).

This section eliminates the 10-year statute of limitations for offenses involving the unlawful procurement of citizenship or naturalization (18 U.S.C. § 1425), allowing indictments or informations to be instituted at any time without limitation. It revises the list of related immigration and passport fraud offenses (i.e., 18 U.S.C. §§ 1423, 1424, 1426-1428, 1541-1544) subject to the 10-year limitations period by excluding § 1425.
