S. 411 — Flight 293 Remembrance Act

This section directs the Secretary of Defense, in consultation with the Secretary of Veterans Affairs, to (1) identify and document all non-combat military plane crashes categorized as “Operational Loss/Non-War Loss” from calendar year 1984 onward (and prior using other sources) not later than one year after enactment and develop and maintain a public database of servicemembers who died in such crashes; (2) provide specified assistance to their families, including benefits awareness, personalized guidance, and peer networks; (3) designate a point of contact within the Department of Defense to guide families, provide updates, and coordinate support; and (4) submit a report to Congress not later than two years after enactment assessing implementation, family satisfaction, and legislative recommendations. This section deems programs and activities under the section—even if carried out directly by the Departments of Defense or Veterans Affairs and not otherwise receiving federal financial assistance—to be education programs receiving such assistance for purposes of the nondiscrimination requirements of Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794), Title IX of the Education Amendments of 1972 (20 U.S.C. 1681 et seq.), and Title VI of the Civil Rights Act of 1964 (42 U.S.C. 2000d et seq.), and directs the Secretaries to issue enforcement regulations.
