S. 414 — ADS for Mental Health Services Act

This section requires covered digital advertising platforms (i.e., social media platforms, websites, online services, or apps with more than 100 million unique monthly users or visitors that primarily host user-generated content forums and derive revenue from advertising) to submit annual reports to the Federal Trade Commission (FTC), beginning one year after enactment, detailing (1) the number and percentage of total advertisements that were public service advertisements (PSAs) during the prior 12 months, (2) the estimated dollar value of such PSAs, (3) the number focusing on local or regional mental and behavioral health care resources, (4) the number promoting free such resources, and (5) how they meet the PSA definition (i.e., free ads without payment that promote SAMHSA-approved resources mitigating self-harm, suicide, eating disorders, substance abuse, behavioral addiction, or social isolation and are relevant to targeted audiences). The FTC must submit annual publicly available summary reports to the Senate Committee on Commerce, Science, and Transportation and the House Committee on Energy and Commerce within 180 days of receiving platform reports. This section sunsets all requirements five years after enactment and specifies that it does not supersede applicable privacy or data security laws.
