S. 4140 — Carlton H. Ingram Veterans’ Benefits Protection Act

This section designates the existing provisions of 38 U.S.C. 1155 as subsection (a) and adds new subsection (b) requiring the Department of Veterans Affairs (VA) schedule of ratings—which determines compensation levels for service-connected disabilities based on average earning capacity impairments—to discount the beneficial effects of medication or treatment when evidence establishes a baseline without those effects. Subsection (b)(2) clarifies that this requirement does not preclude compensation for additional disabilities resulting from such medication or treatment for service-connected injuries or diseases, or for aggravation of preexisting service-connected injuries or diseases.
