This section amends the Help America Vote Act of 2002 to require presentation of a valid photo identification—such as a state-issued driver's license or identification card, U.S. passport, military identification, or tribal identification—as a condition for receiving a ballot to vote in person in federal elections, with provisional ballots available under section 302(a) that must be cured within three days by presenting the identification or a religious objection affidavit. It further requires individuals voting other than in person to submit with the ballot a copy of a valid photo identification or the last four digits of their Social Security number with an affidavit attesting to reasonable efforts to obtain such a copy, except for absent uniformed services voters and voters assigned alternative means of voting under section 3(b)(2)(B)(ii) of the Voting Accessibility for the Elderly and Handicapped Act (52 U.S.C. 20102(b)(2)(B)(ii)). The section directs states, to the extent practicable, to provide free public access to digital imaging devices (e.g., scanners, copiers) at government buildings for copying identifications; requires notification of the identification requirement during voter registration applications, including online; applies the requirements to federal elections held on or after the date of enactment; and makes conforming amendments for Election Assistance Commission guidance and enforcement provisions.
