S. 4161 — Maverick Act

This section authorizes the Secretary of the Navy to convey, without consideration, all right, title, and interest in three surplus F-14D Tomcat aircraft (Bureau Nos. 159437, 164341, 164602)—which lack any munitions-launching or combat capability—to the U.S. Space and Rocket Center Commission in Huntsville, Alabama, via a conditional deed of gift at no cost to the United States. The instrument of conveyance must include conditions that (1) the Navy need not repair or alter the aircraft beforehand or provide further support; (2) the Navy will supply applicable maintenance manuals and may transfer excess spare parts if replenished by the Commission at fair market value; (3) the Commission may enter agreements with nonprofits, subject to Navy approval, to restore and operate the aircraft for public display, airshows, and naval aviation heritage events; and (4) all right, title, and interest reverts to the United States upon breach of Federal Aviation Administration requirements or unauthorized transfer. Post-conveyance, the Commission bears all costs and liability, and the transfer complies with specified laws including arms export controls and the Espionage Act.
