S. 4217 — Copay Fairness for Veterans Act of 2026

This section eliminates copayments for preventive health services furnished by the Department of Veterans Affairs (VA) as follows: (1) medications, including over-the-counter medications, under VA outpatient pharmaceutical services; (2) hospital care and nursing home care; (3) walk-in care; and (4) care furnished to survivors and dependents of veterans. It expands the definition of preventive health services in VA law to encompass (A) immunizations per CDC adult schedule, Advisory Committee on Immunization Practices recommendations, or specified professional organizations; (B) evidence-based items or services with an "A" or "B" rating from the U.S. Preventive Services Task Force (USPSTF) or recommended by specified professional organizations; and (C) specified preventive care, screenings, and contraceptive services (e.g., anxiety, breast/cervical cancer, HIV, domestic violence, and diabetes screenings; domestic violence and STI counseling; breastfeeding services and supplies; contraception, devices, and related services approved, cleared, or licensed under specified FDA authorities including 21 U.S.C. 355; obesity prevention in midlife women; and well-woman visits). The amendments take effect 180 days after enactment and include a rule of construction preserving existing copayment exemptions for preventive services and permitting coverage consistent with evidence-based standards such as Health Resources and Services Administration guidelines.
