S. 4228 — ACE Nuclear Energy Act of 2026

This section requires the Export-Import Bank of the United States to exclude from its default rate calculation under 12 U.S.C. 635g(g)(1) financing provided (i) for transactions relating to civil nuclear facilities, materials, or technology or (ii) pursuant to section 2(l) of the Export-Import Bank Act of 1945. (Thus, such financing does not contribute to default rate thresholds that, if exceeded, limit the Bank's authority to provide new export financing.)

This section increases from 40 to 100 the maximum number of Export-Import Bank of the United States employees whom the Board of Directors may compensate without regard to federal civil service classification (5 U.S.C. ch. 51) and pay provisions (5 U.S.C. ch. 53, subchs. III and VIII).
