S. 4270 — Nicholas Douglas Quets United States-Mexico Rapid Response for Victims of Crime Act

This section states congressional findings concerning the October 18, 2024, murder of U.S. citizen Nicholas Quets by Sinaloa Cartel-associated criminals in Mexico; ongoing threats from transnational criminal organizations and cartel violence to U.S. citizens traveling abroad; deficiencies in binational coordination for investigations of serious crimes such as homicide and kidnapping; and the need for enhanced cooperation between U.S. and Mexican authorities to ensure justice for victims and their families.

This section expresses the sense of Congress that a robust, binational rapid response protocol is necessary to ensure efficient communication and coordination between United States and Mexican authorities when responding to serious crimes involving United States citizens in Mexico.

This section defines, for purposes of the Act, (1) "appropriate congressional committees" as the Senate Committees on Foreign Relations and Judiciary and the House Committees on Foreign Affairs and Judiciary; and (2) "serious crimes" to include homicides and suspicious deaths, kidnappings and abductions, disappearances, violent crimes involving or suspected to involve organized criminal groups or cartels, and other violent crimes designated by the Secretary of State.

This section directs the Secretary of State, in coordination with the Attorney General, to negotiate and establish with Mexico a binational rapid response protocol (Protocol) to ensure timely coordination between U.S. and Mexican authorities in responding to and investigating serious crimes committed against U.S. citizens in Mexico. In negotiations, the Secretary shall seek to include procedures for (1) prompt notification of authorities; (2) secure communication channels; (3) securing crime scenes and protecting evidence; (4) preserving and documenting evidence for potential prosecutions; (5) sharing investigative leads, intelligence, and forensic information; (6) designating Mexican points of contact for extradition requests; (7) designating points of contact in both countries for incident coordination; (8) designating a U.S. point of contact for victims and families; (9) coordinating consular support for victims; and (10) joint training, planning, or exercises.

This section directs the Secretary of State to submit reports to the appropriate congressional committees on a binational rapid response protocol for crimes against U.S. citizens in Mexico. (a) Not later than 180 days after enactment of this Act, and annually thereafter until the protocol is established, the Secretary must submit a progress report describing (1) progress toward negotiating the protocol, (2) the status of U.S.-Mexico cooperation relating to such crimes, and (3) any additional legislative or diplomatic steps to improve coordination and accountability. (b) Not later than 180 days after the protocol is established, and annually thereafter, the Secretary must submit an implementation report describing (1) the status of implementation, (2) actions taken by U.S. and Mexican authorities under the protocol, (3) the extent to which the protocol has improved coordination in covered cases, and (4) recommendations for improving the protocol.

This section provides rules of construction clarifying that nothing in this Act may be construed (1) to limit the sovereignty of the United States or of Mexico; (2) to require the Government of Mexico to adopt investigative procedures inconsistent with existing Mexican law; or (3) to alter the existing authorities of United States law enforcement or consular officials.
