This section states the sense of Congress that export controls on semiconductor manufacturing equipment and components are essential to defending U.S. national security advantages in advanced computing integrated circuits; that specified Chinese entities—ChangXin Memory Technologies, Hua Hong Semiconductor Limited, Huawei Technologies Company, Semiconductor Manufacturing International Corporation, and Yangtze Memory Technologies Corporation—warrant comprehensive controls to limit access to U.S. technologies; and that the United States should align such controls with allies and partners, including through diplomatic agreements.
This section directs the covered agency heads to (1) identify all covered semiconductor manufacturing equipment and covered facilities, submit a list to the appropriate congressional committees, and notify the public in the Federal Register not later than 60 days after enactment and annually thereafter; (2) immediately engage in diplomatic efforts to encourage allied supplier countries to adopt equivalent countrywide export controls and licensing requirements (with denial policy) on such equipment and servicing for covered facilities in countries of concern, and provide a briefing to congressional committees on these efforts not later than 90 days after enactment; (3) issue regulations not later than 150 days after enactment (and annually thereafter) applying countrywide controls to U.S.-produced covered equipment and end-user/end-use restrictions on covered facilities in countries of concern, along with a certification for each allied supplier country that it has adopted equivalent controls or that diplomacy has failed such that delay would undermine U.S. national security (with unilateral controls extended to allied equipment in the latter case, and a possible one-time 90-day waiver); and (4) submit a report to congressional committees not later than 180 days after enactment and annually thereafter that includes a list of all covered semiconductor manufacturing equipment.
