S. 4285 — Guard Equal Benefits for Federal Missions Act

This section establishes a new section 511 in chapter 5 of title 32, U.S. Code, treating specified full-time National Guard duty under 32 U.S.C. §502(f) as service in response to a national emergency for federal benefit purposes. Such duty qualifies if (1) authorized by the President or Secretary of Defense, (2) performed in direct support of federal law enforcement operations coordinated with U.S. Immigration and Customs Enforcement, the Drug Enforcement Administration, the Bureau of Alcohol, Tobacco, Firearms and Explosives, or another agency designated by the Secretary, and (3) carried out to address significant criminal activity, drug trafficking, organized crime, or other public safety threats determined by the Secretary. Qualifying service counts toward (1) reduced retirement age under 10 U.S.C. §12731, (2) the Transitional Assistance Management Program under 10 U.S.C. §1145, (3) the Post-9/11 GI Bill (38 U.S.C. ch. 33), and (4) any other federal benefit based on national emergency service.
