This section defines eight terms used in the Act, including (1) "Commission," "event ticket," and "ticket issuer," which have the same meanings as in the Better Online Ticket Sales Act of 2016 (P.L. 114-274); (2) "base event ticket price," as the price of an event ticket excluding event ticket fees; (3) "event," as a live concert, sporting event, or similar activity in a venue with over 200-person capacity that is open to the public and promoted or sold in interstate commerce; (4) "total event ticket price," as the base price plus event ticket fees; (5) "event ticket fee," as mandatory charges (e.g., service, delivery, and facility fees) beyond the base price, excluding optional products or services; (6) "optional product or service," as one not required to use or possess the ticket; (7) "secondary market ticket issuer," as an entity that regularly resells tickets to the public; and (8) "resale" or "secondary sale," as any ticket sale after the initial sale.
This section requires ticket issuers and secondary market ticket issuers, beginning 120 days after enactment, when offering event tickets for sale, to (1) clearly and conspicuously display the total ticket price in any advertisement, marketing, or price list; (2) clearly and conspicuously disclose the total price when the ticket is first displayed to a potential purchaser and throughout the purchasing process; and (3) provide an itemized list of the base ticket price and each fee.
This section treats a violation of section 3 as a violation of a rule defining an unfair or deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (15 U.S.C. 57a(a)(1)(B)). It further authorizes the Federal Trade Commission (FTC) to enforce section 3 using the same manner, means, jurisdiction, powers, duties, penalties, privileges, and immunities as under the FTC Act (15 U.S.C. 41 et seq.) and preserves all other FTC authorities.
