S. 4307 — Protecting American Consumers from Robocalls Act

This section expands Do Not Call Registry protections under the Communications Act (47 U.S.C. 227(c)) to all telephone subscribers by striking "residential" limitations in multiple provisions. It further revises the private right of action to permit actual or statutory damages of $500 per violation (not "up to $500") for a single telephone call by or on behalf of an entity (from more than one call within any 12-month period by or on behalf of the same entity) and directs the Federal Communications Commission to revise implementing regulations within 270 days of enactment.

This section revises the definition of automatic telephone dialing system (ATDS) under the Telephone Consumer Protection Act to (1) expand telephone number storage or production capacity to include using a list of telephone numbers (previously, only using a random or sequential number generator), and (2) add the capacity to dial such numbers successively without human intervention. (Thus, more calling equipment is likely subject to TCPA prohibitions on non-emergency calls to wireless numbers without prior express consent.)
