S. 4476 — Workforce Transparency Act of 2026

This section provides congressional findings on the current and potential workforce impacts of artificial intelligence systems and states the purposes of the Act, including establishing a federal framework for aggregated, de-identified transparency and data-sharing on AI use relevant to workforce outcomes while protecting privacy and confidential business information.

This section defines terms used in the Act, including aggregated workforce transparency data (i.e., statistical information aggregated across users that does not identify individuals or disclose proprietary AI model details), artificial intelligence, covered AI system (i.e., an AI system made available to consumers or businesses, excluding internal-use, academic, or narrow-function systems), covered AI system provider, enterprise customer, participating entity, and Secretary of Labor.

This section authorizes participating entities to voluntarily submit aggregated workforce transparency data to the Secretary on interactions with covered AI systems. Submissions may cover task or activity categories (e.g., writing, coding, research), geographic distribution by state or metropolitan statistical area, adult age ranges, and temporal trends, provided the data are no more recent than 91 days before submission; the first submission may include data from the preceding 2-year period. The section clarifies that no covered AI system provider or enterprise customer is required to submit such data.

This section establishes privacy, security, and confidentiality safeguards for data submissions under section 4(a) by prohibiting participating entities from submitting personal data linked to individuals, employer-specific performance data, trade secrets, proprietary algorithms, model weights, training datasets, source code, or information restricted by contract or customer terms. It requires entities to exclude or further aggregate data as needed to comply with other applicable laws, directs the application of aggregation, anonymization, and de-identification techniques consistent with guidance under section 6(c), and exempts aggregated workforce transparency data from disclosure under the Freedom of Information Act.

This section designates the Secretary of Labor, acting through the Commissioner of Labor Statistics and in coordination with the Secretary of Commerce acting through the Director of the Bureau of the Census, as the lead agency to administer the Act. This section requires the Secretary to establish and maintain a publicly available online database of aggregated workforce transparency data and to submit an annual report to Congress summarizing such data, while ensuring that no published dataset, analysis, or report attributes information to any specific participating entity or identifiable person. This section directs the Secretary to issue non-binding guidance and regulations not later than 180 days after enactment addressing standardized reporting formats, acceptable aggregation and privacy-preserving methods, procedures to minimize reporting burden, definitions for broad task or activity categories in artificial intelligence usage reporting, and the extent of required anonymization for submissions. This section also requires the Secretary to establish a working group to develop processes for publishing or enhancing public labor-market data that combines age and occupational information to assess how artificial intelligence affects entry-level workers and early-career professionals.

This section authorizes the Secretary to seek injunctive relief in any court of competent jurisdiction against a participating entity for knowing and willful misrepresentations in aggregated workforce transparency data submitted under section 4(a).

This section provides a severability clause, stipulating that if any provision of the Act or its application to any person or circumstance is held unconstitutional, the remainder of the Act and its application to other persons or circumstances remains in effect.
