S. 455 — Protecting Sensitive Locations Act

This section amends INA §287 (8 U.S.C. 1357), which authorizes immigration enforcement powers for DHS officers and agents, by adding restrictions on enforcement actions within 1,000 feet of a sensitive location (i.e., typically including schools, churches, hospitals, and courthouses per longstanding DHS policy). It (1) generally prohibits such actions except under exigent circumstances, with mandatory consultation and supervisor approval if uncertain and immediate cessation otherwise; (2) requires discreet conduct, time limits, and targeting only approved individuals when proceeding; (3) exempts medical transports near borders and rare premeditated arrests of terrorists, national security threats, or extraordinary public safety dangers with prior written approval; (4) bars evidence from violations in removal proceedings and allows motions to terminate such proceedings; (5) mandates annual training on these rules, related notice provisions, and courthouse enforcement limits for employees under specified ICE and CBP officials; and (6) requires the Secretary of Homeland Security to report details of each sensitive-location action within 30 days to DHS's Inspector General and Office for Civil Rights and Civil Liberties.
