S. 460 — Supporting Made in America Energy Act

This section requires the Secretary of the Interior to conduct, notwithstanding any other provision of law, a minimum of four onshore oil and natural gas lease sales annually in each of Wyoming, New Mexico, Colorado, Utah, Montana, North Dakota, Oklahoma, Nevada, and any other state with available land under the Mineral Leasing Act (30 U.S.C. 181 et seq.), beginning in FY2025; offer all parcels eligible for development under the applicable resource management plan; and hold replacement sales in the same calendar year if any sale is canceled, delayed, or deferred. This section further requires two annual region-wide offshore oil and natural gas lease sales in the Gulf of Mexico outer Continental Shelf (OCS) region (Central and Western Planning Areas), beginning in FY2026 through 2035 on specified semiannual dates (March 31 and August 31), using terms from Lease Sale 261 (88 Fed. Reg. 80750); extends the moratorium on leasing in the Eastern Gulf of Mexico to December 31, 2035 (from June 30, 2022) under the Gulf of Mexico Energy Security Act of 2006 and adds the South Atlantic and Straits of Florida Planning Areas to that moratorium, with exceptions for valid existing leases and environmental conservation leases (e.g., shore protection); and mandates a minimum of six lease sales in Alaska's Cook Inlet Planning Area over 10 years from enactment, offering at least 1 million acres per sale, issuing leases within 90 days of receiving acceptable bids, and applying a 12.5% royalty rate. This section amends section 18 of the Outer Continental Shelf Lands Act (43 U.S.C. 1344) to (1) expand the procedures reference for the five-year OCS oil and gas leasing program from subsections (c) and (d) to (c) through (f); (2) redesignate subsections (f) through (i) as (g) through (j); and (3) require the Secretary to begin preparing each subsequent leasing program not later than 36 months after the first lease sale under the prior program.
