S. 478 — Veterans 2nd Amendment Protection Act of 2025

This section prohibits the Secretary of Veterans Affairs from transmitting to the Department of Justice, for use by the national instant criminal background check system (NICS), personally identifiable information of a beneficiary solely on the basis of a determination to pay benefits to a fiduciary under 38 U.S.C. §5502, absent an order or finding by a judge, magistrate, or other judicial authority of competent jurisdiction that the beneficiary poses a danger to self or others. (Thus, this limits VA reporting to NICS—currently done for beneficiaries deemed mentally incompetent via fiduciary appointment—of such individuals as prohibited from firearm possession under 18 U.S.C. §922(g)(4).)
