S. 49 — Expel Illegal Chinese Police Act of 2025

This section requires the President, on and after enactment, to impose (1) property-blocking sanctions under the International Emergency Economic Powers Act (IEEPA, 50 U.S.C. 1701 et seq.)—exercising all powers under IEEPA section 1702—on foreign persons determined to be Chinese provincial, municipal, or other police departments (including those in Xinjiang Uyghur Autonomous Region and Fujian), their senior leaders, or persons associated with establishing a Chinese police presence in the U.S. or acting under direction of such departments or the United Front Work Department to monitor or intimidate U.S. residents; and (2) immigration sanctions under the Immigration and Nationality Act—rendering specified aliens inadmissible, ineligible for visas or parole, and subject to visa revocation with immediate effect—on employees of such departments or United Front associates, their immediate family members (i.e., spouse, parent, sibling, or adult child), or persons associated with such presences in the U.S. (As background, IEEPA authorizes the President to block property and prohibit transactions involving designated foreign persons during declared national emergencies.) This section further authorizes the President to waive sanctions on a case-by-case basis for up to 30 days upon certifying to Congress at least 15 days prior that the waiver is vital to U.S. national security (potentially in classified form); subjects violators to IEEPA civil and criminal penalties (50 U.S.C. 1705(b)-(c)); directs federal agencies not to participate in non-U.S. government-initiated investigations of designated persons unless vital to U.S. citizens' health, safety, or well-being; and defines key terms including foreign person, U.S. person, and immediate family member. (Thus, the provision mandates sanctions without requiring a new national emergency declaration and leverages existing IEEPA implementation authorities under 50 U.S.C. 1702 and 1704.)
