S. 592 — Simplifying Subcontracting Act

This section amends the Small Business Act's requirements for prime contractors' subcontracting plans by adding a representation that all subcontract solicitations will be communicated in plain writing (as defined in the Plain Writing Act of 2010, i.e., clear and simple language) to ensure small business concerns can easily understand subcontracting opportunities, with such contractors required to include this plain writing requirement in their subcontracts. (As background, sec. 8(d) of the Small Business Act requires prime contractors on federal contracts exceeding specified thresholds to maximize subcontracting opportunities for small businesses through detailed plans and outreach.) It further requires prime contractors determined by the Small Business Administration to have violated this requirement to issue a new plain writing solicitation within 30 days and directs the SBA Administrator to promulgate implementing regulations within 90 days of enactment.
