S. 593 — Nationwide Consumer and Fuel Retailer Choice Act of 2025

This section revises fuel waiver authorities and Reid vapor pressure (RVP) limitations under Clean Air Act (CAA) §211(f)(4) and (h) to facilitate introduction of gasoline-ethanol blends containing 10 to 15 percent denatured anhydrous ethanol (from 10 percent). Specifically, it (1) adds a new waiver provision allowing such fuels or additives to be introduced into commerce if substantially similar to those used in vehicle certification or meeting all prior waiver conditions except any RVP limitation and complying with other RVP requirements; (2) expands the RVP adjustment in CAA §211(h)(4) to such 10-15 percent blends; and (3) requires post-enactment notifications for future state opt-ins while applying the expanded RVP limitation upon enactment to all previously notified states during high ozone season. (RVP standards limit gasoline volatility to curb evaporative emissions contributing to ozone formation; the prior 1.0 pounds per square inch (psi) adjustment applied only to 10 percent ethanol blends in certain areas.) This section also adds CAA §211(o)(9)(E) to return or reinstate retired Renewable Fuel Standard (RFS) compliance credits—or deem them eligible for future use or apply them in the EPA Moderated Transaction System—to small refineries with outstanding exemption petitions for compliance years 2016-2018 under specified conditions. (The RFS requires transportation fuel to contain specified renewable fuel volumes; small refineries may petition for temporary exemptions from compliance.)
