This section defines terms for purposes of the Act: (1) Advisory Council, as the advisory council established under section 3(c)(1); (2) Director, as the Director of the Office; (3) gun violence, to include homicide, violent crime, domestic violence, attempted suicide, suicide, and unintentional death or injury involving a firearm; and (4) Office, as the Office of Gun Violence Prevention established under section 3(a).
This section establishes within the Department of Justice's Office of Legal Policy the Office of Gun Violence Prevention, headed by a Director appointed by the Attorney General. The Director, in consultation with an advisory council, must (1) coordinate and maximize the efficacy of gun violence prevention responsibilities, programs, and services across specified DOJ components—including the national instant criminal background check system (NICS) established under 34 U.S.C. 40901, which provides immediate checks on prospective firearm transferees—and other federal agencies; (2) evaluate relevant laws, regulations, programs, offices, data sources, and grants; (3) recommend legislative and executive policies to Congress and the President; (4) identify data gaps and develop a collection plan; (5) assess DOJ research and establish a comprehensive agenda; (6) educate the public, including firearm owners, parents, and affected professionals, on federal laws and secure firearm storage; (7) assist communities after gun violence incidents with crisis response, mental health services, anti-trafficking, training, and suicide prevention; and (8) submit annual reports to Congress beginning one year after enactment on gun violence, policy recommendations, and office activities. This section further requires the Attorney General to convene, not later than 180 days after enactment and quarterly thereafter, an advisory council chaired by the Director and including specified DOJ officials.
