S. 60 — Write the Laws Act

This section states the constitutional authority for the Act, citing Congress's legislative powers under Article I, Section 1, and the Necessary and Proper Clause (Article I, Section 8, cl. 18). It further states that the Act brings the enforcement of federal law into compliance with the Fifth Amendment's Due Process Clause.

This section states 14 congressional findings asserting that the Constitution vests legislative powers exclusively in Congress, executive power in the President, and judicial power in one Supreme Court and such inferior courts as Congress may establish; that Congress has unconstitutionally delegated these powers to administrative agencies since the late 19th century; and that such delegations violate separation of powers, due process under the Fifth Amendment, and related constitutional principles.

This section establishes chapter 2A in Title 1, United States Code, titled "Separation of Powers" (effective 90 days after enactment), which prohibits any Act of Congress from delegating legislative powers—defined to include creating or clarifying criminal or civil offenses or any non-criminal regulation, prohibition, or limitation not fully defined in statute (with limited exceptions for factual implementation findings, presidential proclamations, internal agency rules, or grant/contract conditions)—to the legislative or executive branches (including the President), the judiciary, agencies, quasi-public agencies, states, or other entities. It further prohibits new or amended presidential directives, adjudicative decisions, rules, or regulations governing or penalizing non-federal actors unless authorized by a compliant Act of Congress; nullifies noncompliant measures with no legal effect; authorizes private causes of action for injunctions or other relief against the United States (with de novo review); and directs the Comptroller General to report to Congress within six months on statutes enacted before 90 days post-enactment containing prohibited delegations.

This section provides a severability clause, stating that if any provision of the Act or its amendments, or their application to any person or circumstance, is held invalid, the remainder of the Act and its amendments, and their application to other persons or circumstances, remains in effect.
