S. 643 — A bill to amend the Grand Ronde Reservation Act to address the hunting, fishing, trapping, and animal gathering rights of the Confederated Tribes of the Grand Ronde Community, and for other purposes.

This section revises Section 2 of Public Law 100-425 (Grand Ronde Reservation Act) by replacing it with provisions governing hunting, fishing, trapping, and animal gathering rights of the Confederated Tribes of the Grand Ronde Community of Oregon. The revised section (1) defines terms including the Grand Ronde Hunting and Fishing Agreement (entered December 2, 1986), the Consent Decree (entered January 12, 1987, by the U.S. District Court for the District of Oregon), and "Indian Tribe" (as defined in 25 U.S.C. 5304); (2) maintains the 1986 Agreement in effect unless replaced or amended by successor government-to-government agreements between the Tribe and State of Oregon, which cannot affirm, expand, limit, or affect tribal rights (including treaty rights), cannot restrict the state's separate agreements with other tribes, cannot be used in court to modify tribal rights, and must derive post-enactment rights solely from state authority; (3) requires the U.S. District Court for the District of Oregon to review any action seeking to rescind, overturn, modify, or obtain relief from the Consent Decree on the merits, without regard to res judicata or collateral estoppel; and (4) states that nothing in the section or any successor agreement affects the rights or claims of any Indian tribe.
