This section defines terms related to improving retrospective reviews of agency regulations (i.e., post-issuance reviews required by law or deemed appropriate by an agency head) and directs the following actions: (1) requires the Director of the Office of Management and Budget (OMB), acting through the Administrator of the Office of Information and Regulatory Affairs (OIRA), in consultation with the Director of the Government Publishing Office (GPO), Archivist of the United States, and Director of the Federal Register, to submit to designated congressional committees (i.e., House Oversight and Senate Homeland Security and Governmental Affairs Committees) a report within 180 days of enactment assessing the availability of agency regulations in machine-readable format and the Administrative Committee of the Federal Register's recognition of the electronic Code of Federal Regulations (eCFR) as an official legal edition; (2) requires the OMB Director, acting through the OIRA Administrator, to issue guidance within 18 months of enactment on agency use of technology (including algorithmic tools and artificial intelligence) to conduct retrospective reviews—such as identifying obsolete, burdensome, erroneous, or redundant regulations—and to train agency personnel, taking into account the report under (1); (3) requires each agency head to submit to the OIRA Administrator and designated committees a retrospective review plan within two years of enactment that details a strategy for implementing the guidance, identifies regulations or categories requiring or benefiting from review, and includes relevant data; and (4) requires each agency head to implement the plan's strategy within 180 days of submission with respect to any retrospective review.
