S. 669 — DEFUND Act of 2025

This section (1) repeals the United Nations Participation Act of 1945, which authorizes U.S. membership and participation in the United Nations; (2) directs the President to terminate U.S. membership in the United Nations and any of its organs, specialized agencies, commissions, or other formally affiliated bodies; and (3) closes the U.S. Mission to the United Nations, prohibiting any remaining functions of the office.

This section repeals the United Nations Headquarters Agreement Act (Joint Resolution of August 4, 1947; 22 U.S.C. 287 note) and withdraws the United States from the 1947 United Nations Headquarters Agreement (signed June 26, 1947). (As background, the agreement designates an 18-acre headquarters district in New York City for the United Nations and grants the organization, its personnel, and visitors specified privileges, immunities, and law enforcement authorities.)

This section prohibits the appropriation or availability of funds for U.S. assessed or voluntary contributions to the United Nations or any organ, specialized agency, commission, or other affiliated body, except to facilitate termination of U.S. membership and withdrawal of U.S. personnel and equipment as provided in sections 2 and 3. Upon termination of U.S. membership, the section further prohibits any payments to the United Nations or affiliates from funds appropriated prior to termination or from any other available funds.

This section (1) prohibits the United Nations and its affiliates from occupying or using any U.S. government property or facilities and (2) terminates diplomatic immunities and privileges for UN personnel and foreign mission representatives to the UN under the Vienna Convention on Diplomatic Relations, the International Organizations Immunities Act, the UN Headquarters Agreement, and the Convention on the Privileges and Immunities of the United Nations. (Thus, such individuals would be subject to U.S. laws without diplomatic protections.)

This section repeals the joint resolution authorizing United States membership and participation in the World Health Organization (WHO). (Thus, this terminates U.S. membership in the WHO, the principal United Nations agency directing and coordinating international health responses.)

This section terminates U.S. participation in all conventions and agreements with the United Nations and any of its organs, specialized agencies, commissions, or other formally affiliated bodies. It further directs that no remaining functions of such conventions and agreements be carried out.

This section prohibits the President from entering into any agreement for U.S. membership in the United Nations (UN) or any UN organ, specialized agency, commission, or other formally affiliated body without the advice and consent of the Senate. It further requires that any such Senate advice and consent be subject to a reservation—reserving the U.S. right to withdraw from the agreement—which must be included in the instrument of ratification.
