This section establishes the Office of the Inspector General for Ukraine, headed by an Inspector General appointed by the President with Senate advice and consent not later than 30 days after enactment of this Act, with basic pay at level IV of the Executive Schedule under 5 U.S.C. §5315 and qualifications based solely on integrity and expertise in specified fields (i.e., accounting, auditing, financial analysis, law, management analysis, public administration, or investigations). The Inspector General must appoint an Assistant Inspector General for Auditing, responsible for auditing programs and operations funded by amounts appropriated or otherwise made available for military and nonmilitary support of Ukraine, and an Assistant Inspector General for Investigations, responsible for related investigative activities. The Inspector General reports to, and is under the general supervision of, the Secretary of State and Secretary of Defense but retains independence to initiate, carry out, and complete audits and investigations (including issuing subpoenas) without interference from specified department or agency officers. Duties of the Inspector General include (1) conducting, supervising, and coordinating audits and investigations of the treatment, handling, and expenditure of Ukraine support funds and related programs, operations, and contracts—including oversight of obligations and expenditures; monitoring of contracts, fund transfers, and military/nonmilitary activities; maintenance of records; investigation of overpayments or unethical/illegal actions with referrals to the Department of Justice; and tracking of lethal/nonlethal security assistance with end-use compliance reviews; (2) establishing related systems, procedures, and controls; (3) performing duties and responsibilities of inspectors general under 5 U.S.C. chapter 4; and (4) coordinating with the Inspectors General of the Departments of Defense and State and the U.S. Agency for International Development. The Inspector General has authorities under 5 U.S.C. §406 (including subsection (e)), must follow audit standards under 5 U.S.C. §404(b)(1), and may appoint necessary personnel subject to civil service laws.
