S. 677 — Border Airport Fairness Act of 2025

This section directs the President, pursuant to 19 U.S.C. 2 (authorizing establishment of ports of entry), to designate as ports of entry certain primary airports (i.e., commercial service airports under 49 U.S.C. 47102(16)) located not more than 30 miles from the U.S. northern or southern international land border that are formally associated with a land border crossing or seaport within 30 miles and meet U.S. Customs and Border Protection numerical criteria for ports of entry (as specified in Treasury Decision 82–37, as revised). The section further directs the President to terminate application of the user fee under 19 U.S.C. 58b (i.e., fees for customs processing at airports not designated as international ports of entry for aircraft) with respect to such airports. (Thus, these airports may process international arrivals with full CBP preclearance services without user fees.)
