S. 707 — No Bailout for Sanctuary Cities Act

This section defines a "sanctuary jurisdiction" as any state or political subdivision with a statute, ordinance, policy, or practice that prohibits or restricts any government entity or official from (1) sending, receiving, maintaining, or exchanging information regarding an individual's citizenship or immigration status with federal, state, or local government entities; or (2) complying with a detainer or release notification request from the Secretary of Homeland Security under INA §236 (8 U.S.C. 1226, governing alien detention pending removal decisions) or §287 (8 U.S.C. 1357, governing immigration officer powers). It excepts from this definition any such policy applied solely to individuals who come forward as victims or witnesses to criminal offenses.

This section makes sanctuary jurisdictions ineligible to receive federal funds that such jurisdictions intend to use for the benefit (including food, shelter, healthcare services, legal services, and transportation) of aliens present in the United States without lawful status under the immigration laws (as defined in 8 U.S.C. 1101), beginning on the earlier of 60 days after enactment or the first day of the fiscal year following enactment.

This section requires the Secretary of Homeland Security to submit to the Senate and House Judiciary Committees, not later than one year after enactment and annually thereafter, a report identifying each state and political subdivision that failed to comply with a request under section 2(a)(2) in the preceding one-year period.
