This section prohibits an agency from issuing any rule unless the agency first repeals 10 or more existing rules that impose costs or responsibilities on nongovernmental persons or state or local governments (including federally recognized Indian tribes), to the extent practicable related to the new rule. For a major rule, the agency also must ensure the new rule's cost is less than or equal to the cost of the repealed rules, as certified by the Office of Information and Regulatory Affairs Administrator, with all repealed rules published in the Federal Register. (Thus, the provision effectively requires a net reduction in applicable regulations.) It exempts agency internal policies or procurement rules and revisions that decrease burdens or compliance costs; directs agency heads to submit a review report to Congress and the Office of Management and Budget Director within 90 days of enactment identifying costly, ineffective, duplicative, or outdated rules; and requires the President to report to Congress within five years on the number of rules in effect and reduction status over the prior five years.
