S. 723 — Tribal Trust Land Homeownership Act of 2025

This section defines 11 terms for purposes of the Act, including "applicable Bureau office" (i.e., a Bureau of Indian Affairs regional office, agency office, or land titles and records office); "Bureau" (i.e., Bureau of Indian Affairs); "Director" (i.e., Director of the Bureau); "first certified title status report" (i.e., title status report to verify title on Indian land); "Indian land"; "land mortgage" (i.e., mortgage by an individual Indian trust land owner for home acquisition, construction, improvements, or economic development); "leasehold mortgage"; "mortgage package" (i.e., proposed residential or business leasehold mortgage, land mortgage, or right-of-way document submitted under section 3(a)(1)); "relevant Federal agency" (i.e., Department of Agriculture, Department of Housing and Urban Development, or Department of Veterans Affairs); "right-of-way document"; and "subsequent certified title status report" (i.e., title status report to identify liens on residential, business, or land leases on Indian land).

This section establishes deadlines for applicable Bureau of Indian Affairs offices to review and process proposed residential leasehold mortgages, business leasehold mortgages, land mortgages, and right-of-way documents on restricted Indian lands. It requires (1) notification of receipt as soon as practicable; (2) preliminary review for completeness within 10 calendar days, with notice of missing documents within 2 calendar days; (3) approval or disapproval in writing—within 20 calendar days for leasehold mortgages and 30 calendar days for right-of-way documents or land mortgages after receipt of a complete package (with disapprovals stating the basis), except for mortgages by tribes approved for self-leasing under 25 U.S.C. 415(d) and (h); and (4) completion of certified title status reports within 10 calendar days after approval (or 14 calendar days after a request for an initial report), with notice to lenders electronically and by mail. It further requires immediate notice of any missed deadlines to submitters and lenders, plus responses to status inquiries within 2 calendar days.

This section establishes within the Division of Real Estate Services of the Bureau the position of Realty Ombudsman, who reports directly to the Secretary of the Interior. The Realty Ombudsman shall (1) ensure applicable Bureau offices meet mortgage review and processing deadlines and notice requirements under section 3; (2) serve as a liaison to other federal agencies on mortgages involving Indian land; and (3) receive inquiries, questions, and complaints from Indian tribes, tribal members, and lenders regarding executed residential leasehold mortgages, business leasehold mortgages, land mortgages, or right-of-way documents, and act as intermediary in resolving them with the Bureau.
