S. 727 — U.S. Customs and Border Protection Officer Retirement Technical Corrections Act

This section defines "Eligible Individuals" as U.S. Customs and Border Protection (CBP) officers who received a tentative employment offer before July 6, 2008, and entered duty on or after that date; deems them as serving on July 6, 2008, for purposes of enhanced retirement benefits under section 535(e) of the Department of Homeland Security Appropriations Act, 2008 (i.e., minimum annuity amounts under subsection (e)(2)(C) and exemption from mandatory retirement at age 57 under 5 U.S.C. §8425(b)(1)); and entitles them to retroactive annuity corrections. (As background, those provisions offered CBP law enforcement officers a higher Federal Employees Retirement System annuity floor and delayed mandatory retirement to support border security staffing.) It further directs the Secretary of Homeland Security, within 120 days of enactment, to identify and notify Eligible Individuals and provide the Office of Personnel Management (OPM) with information for annuity adjustments (including retroactive payments for retirees); authorizes the Secretary to retroactively waive maximum entry age requirements under 5 U.S.C. §3307(g); and requires OPM, in consultation with the Secretary, to issue implementation guidance. It requires the Government Accountability Office, within 18 months of enactment, to review CBP hiring practices and internal controls for these retirement benefits and report to the Senate Committee on Homeland Security and Governmental Affairs and the House Committees on Homeland Security and Oversight and Government Reform.
