S. 729 — Hospital Transparency Compliance Enforcement Act

This section amends hospital price transparency requirements by— (1) requiring each hospital to establish and make public (and annually update) its list of standard charges not later than 6 months after enactment (or after beginning operations, for newly operating hospitals); (2) prohibiting hospitals from shielding such information from online search results through webpage coding; (3) imposing civil monetary penalties for noncompliance of up to $600 per day (hospitals with 30 or fewer beds), $20 per bed per day (hospitals with more than 30 but no more than 550 beds), or $11,000 per day (hospitals with more than 550 beds), payable within 60 days of notice or final decision; and (4) directing the Secretary to publish a list of noncompliant hospitals beginning 280 days after enactment and every 180 days thereafter. (As background, the requirements apply to all U.S. hospitals and mandate online disclosure of standard charges for shoppable services and all hospital items and services to enable consumer price comparisons.)
