S. 744 — Maintaining American Superiority by Improving Export Control Transparency Act

This section requires the Secretary of Commerce to submit to the appropriate congressional committees (i.e., House Foreign Affairs Committee and Senate Banking Committee), not later than one year after enactment and annually thereafter (subject to appropriations), a report on license applications, enforcement actions, and other requests for authorization for the export, reexport, release, and in-country transfer of items controlled under the Export Control Reform Act of 2018 to covered entities. The report must include (1) for each such application or request, the submitting entity's name, item description (including Export Control Classification Number and control level, if applicable), end-user name and location, value estimate, decision, and submission date; (2) dates, locations, and results of related enforcement activities (e.g., end-use checks); and (3) aggregate statistics on all such applications and requests. All report information except aggregates is exempt from public disclosure under ECRA confidentiality provisions. Covered entities are those located or operating in Country Group D:5 countries (i.e., national security concerns such as China and Russia) and listed on the Entity List or Military End User List in the Export Administration Regulations.
