S. 762 — No Immigration Benefits for Hamas Terrorists Act

This section amends the Immigration and Nationality Act (INA) to expand terrorist activity grounds of inadmissibility under INA §212(a)(3)(B)(i) by adding "senior member" after "representative" and inserting "or an officer, official representative, member, or spokesman of Palestinian Islamic Jihad or Hamas" after "Palestine Liberation Organization"; and adds new INA §212(a)(3)(H) deeming inadmissible any alien who carried out, participated in, planned, financed, afforded material support to, or otherwise facilitated attacks against Israel initiated by Hamas beginning October 7, 2023. It further adds new INA §241(b)(3)(D) rendering such aliens ineligible for relief under the immigration laws, including withholding of removal, asylum under INA §208, and relief under specified authorities related to deportation suspension and special rule for certain aliens (Foreign Relations Authorization Act, Fiscal Years 1998 and 1999, P.L. 105-277). This section makes a conforming amendment to INA §237(a)(4)(B), adding references to new subparagraph (H) as a deportability ground; and requires the Secretary of Homeland Security to submit to Congress, not later than one year after enactment and annually thereafter, a report identifying the number of aliens deemed inadmissible under new INA §212(a)(3)(H) or removable under amended INA §237(a)(4)(B). (Thus, affected aliens are barred from U.S. admission, visas, and immigration relief, and subject to removal.)
