S. 767 — HIDTA Enhancement Act

This section amends provisions governing the High Intensity Drug Trafficking Areas (HIDTA) program—under which the Office of National Drug Control Policy designates multijurisdictional areas experiencing serious drug trafficking problems and coordinates federal assistance to federal, state, local, and tribal law enforcement to disrupt such trafficking—as follows: (1) requires the annual HIDTA report to Congress to include information on the use of HIDTA funds to investigate fentanyl trafficking organizations and individuals, including amounts seized and data from regional threat assessments on fentanyl patterns and trends; (2) requires HIDTA performance plans to identify any limitations on achieving program goals and related recommendations, including on resources, partnerships, or changes in authority or law; (3) authorizes $333 million annually for the HIDTA program for FY2025 through FY2030; (4) increases authorization for specified HIDTA activities to $14,224,000 (from $10,000,000) and expands permissible uses to include assistance for fentanyl interdiction and any other Director-determined purpose to enhance fentanyl prevention, seizure, and interdiction; and (5) directs the Attorney General to provide sufficient prosecutorial resources—including temporary reassignment of assistant U.S. attorneys prioritizing fentanyl trafficking cases—for HIDTA purposes through FY2030, with a process for such requests to be established within 180 days of enactment.
