S. 792 — Government Spectrum Valuation Act

This section establishes requirements under the National Telecommunications and Information Administration Organization Act for the National Telecommunications and Information Administration (NTIA), in consultation with the Federal Communications Commission and Office of Management and Budget, to estimate the market value of electromagnetic spectrum (3 kilohertz to 95 gigahertz) assigned to federal entities. Estimates must assume reallocation to the highest-value licensed or unlicensed commercial wireless use (considering federal mission needs and incorporating dynamic scoring where practicable), with public disclosure of methodology except for classified, law enforcement-sensitive, or proprietary information (available to Congress in a classified annex upon request). NTIA must complete initial estimates on the following schedule, with updates every three years thereafter: (1) 3-33 gigahertz within one year of enactment; (2) 33-66 gigahertz within two years of enactment; and (3) 66-95 gigahertz within three years of enactment. Requires each federal entity to report its most recent spectrum value estimate (1) in its budget submission for inclusion in the President's annual budget under 31 U.S.C. 1105(a) and (2) in its annual financial statement under 31 U.S.C. 3515. Makes technical and conforming amendments, including redesignating section 105 as section 106.
