S. 797 — Family Building FEHB Fairness Act

This section authorizes fertility treatment benefits in the Service Benefit Plan and Indemnity Benefit Plan under the Federal Employees Health Benefits (FEHB) program (i.e., health insurance for approximately 8 million federal civilian employees, retirees, and dependents). It defines fertility treatment to include (1) preservation of human oocytes, sperm, or embryos; (2) artificial insemination (e.g., intravaginal, intracervical, intrauterine); (3) assisted reproductive technology such as in vitro fertilization; (4) genetic testing of embryos; (5) fertility medications; (6) gamete donation; and (7) other related services as determined by the Office of Personnel Management in coordination with the Secretary of Health and Human Services. The amendments take effect one year after enactment.
