S. 81 — Guidance Clarity Act of 2025

This section requires each federal agency, as defined in 5 U.S.C. §551, to include a specified "guidance clarity statement"—stating that the document lacks the force of law, does not bind the public or agency, and only provides clarity on existing legal or policy requirements—prominently on the first page of any guidance issued under 5 U.S.C. §553(b)(3)(A) (i.e., interpretive rules, general policy statements, or rules of agency organization, procedure, or practice exempt from notice-and-comment rulemaking), beginning 30 days after the OMB Director issues implementing guidance. The OMB Director must issue such guidance within 90 days of enactment.
