S. 833 — Move the ICC Out of NYC Act of 2025

This section states congressional findings concerning the United Nations and the International Criminal Court (ICC), including (1) Senate ratification of the UN Charter in 1945; (2) enactment of the United Nations Headquarters Agreement Act in 1947 (22 U.S.C. 287 note) to authorize the UN headquarters in New York, New York; (3) non-ratification of the Rome Statute of the ICC; (4) lack of ICC jurisdiction within the United States or over U.S. persons; (5) location of an ICC office within the UN headquarters in New York, New York; and (6) amendments to the UN Headquarters Agreement through supplemental agreements negotiated by the U.S. Ambassador to the United Nations.

This section defines, for purposes of the Act, (1) the International Criminal Court and Rome Statute as having the meanings given those terms in section 2013 of the American Service-Members’ Protection Act (22 U.S.C. 7432); and (2) the United Nations Headquarters Agreement as the agreement signed at Lake Success on June 26, 1947, and entered into force on November 21, 1947, between the United Nations and the United States.

This section directs the United States Ambassador to the United Nations to seek negotiations at the United Nations, not later than 30 days after the opening date of the 80th session of the United Nations General Assembly, for a supplemental agreement to the United Nations Headquarters Agreement that prohibits the United Nations from hosting, leasing, or otherwise allowing use of its facilities within the United States by the International Criminal Court.
