S. 84 — Sarah's Law

This section amends INA §236(c) (8 U.S.C. 1226(c)), which requires DHS to detain specified criminal and terrorist aliens pending a removal decision (with release permitted only for certain witness protection needs), by (1) adding as a new mandatory detention category any alien who was not inspected and admitted, held a revoked nonimmigrant visa under INA §221(i), or violated nonimmigrant status under INA §237(a)(1)(C)(i) and who has been charged with a crime resulting in death or serious bodily injury (as defined in 18 U.S.C. §1365(h)(3)); and (2) requiring the Assistant Secretary of ICE for Enforcement and Removal Operations, upon encountering or learning of any alien subject to mandatory detention under that subsection, to make reasonable efforts to identify crime victims and provide them (or, if deceased, a parent, guardian, spouse, or closest living relative) timely information on the alien's name/aliases, date of birth, nationality, immigration status, criminal history, custody status and changes, and U.S. government removal efforts.

This section provides a savings clause stating that nothing in this Act or the amendments made by this Act may be construed to limit the rights of crime victims under any other provision of law, including 18 U.S.C. 3771 (Crime Victims' Rights Act).
