S. 883 — Unlocking Domestic LNG Potential Act of 2025

This section eliminates the Federal Energy Regulatory Commission's (FERC) requirement for prior authorization of natural gas exports from or imports into the United States (previously required under former subsection (a) unless consistent with the public interest, with expedited approval under former subsection (c) for free trade agreement nations). It vests FERC with exclusive authority to approve or deny applications for the siting, construction, expansion, or operation of any such export or import facility—including LNG terminals—deeming the associated importation or exportation consistent with the public interest (expanding from FERC's prior exclusive authority limited to LNG terminals under former subsection (e)); preserves states' rights under the Coastal Zone Management Act, Clean Air Act, and Federal Water Pollution Control Act (as former subsection (d), redesignated as subsection (c)); and adds a rule of construction clarifying that the Natural Gas Act does not limit the President's authority under the Constitution or laws such as the International Emergency Economic Powers Act, National Emergencies Act, Trading with the Enemy Act, or sanctions applicable to state sponsors of terrorism to prohibit such imports or exports.
