S. 892 — Veteran Fraud Reimbursement Act of 2025

This section revises 38 U.S.C. 6107 governing reissuance of Department of Veterans Affairs (VA) benefits misused by a fiduciary (i.e., an individual or entity appointed to manage benefits for a mentally incompetent veteran or beneficiary). It requires the Secretary to reissue to the beneficiary or successor fiduciary an amount equal to all misused benefits, without regard to whether the misuse resulted from the Secretary's negligence (previously required under separate provisions for negligent and non-negligent cases); requires good faith recoupment efforts from the fiduciary and prompt remittance of recouped amounts to the extent not already reissued; directs payment for a deceased beneficiary per 38 U.S.C. 5121 except to the misusing fiduciary; and limits total reissuance to the misused amount. The section further requires the Secretary to establish methods and timing for determining Secretary negligence in misuse cases but prohibits withholding reissuance pending such determination and relieves the Secretary of the requirement to make the determination for every instance of misuse.
