S. 899 — Producer and Agricultural Credit Enhancement Act of 2025

This section increases maximum unpaid indebtedness limits per borrower for Farm Service Agency (FSA) loans as follows: (1) for farm ownership loans, to $850,000 for direct loans (from $600,000) and $3 million for guaranteed loans (from $1.75 million), with inflation adjustments (based on the Prices Paid by Farmers Index) beginning in FY2025 (from FY2019); and (2) for operating loans, to $750,000 for direct loans (from $400,000) and $2.6 million for guaranteed loans (from $1.75 million), with inflation adjustments beginning in FY2025 (from FY2019). (Thus, these loans—capped at the lesser of the security value or the statutory limit—enable more borrowing capacity for farmers to purchase land and equipment or cover annual operating costs.)

This section revises the calculation of the inflation percentage used to increase maximum unpaid indebtedness limits for farm ownership and operating loans—from the Prices Paid by Farmers Index to the equally weighted average percentage change in per-acre U.S. farm real estate value, cropland value, and pasture value as published annually in USDA's National Agricultural Statistics Service Agricultural Land Values report. (As background, these limits cap direct loans at $600,000 and guaranteed loans at $1,750,000—both adjustable for inflation since FY2019—and cannot exceed the value of the farm or other security.)

This section eliminates the $667,000 cap on principal amounts for down payment loans under the farm ownership down payment loan program for eligible farmers and ranchers. Loans may now equal up to 45% of the lesser of the purchase price or appraised value of the farm or ranch to be purchased (previously, 45% of the least of the purchase price, appraised value, or $667,000), subject to overall farm ownership loan limits under section 305(a).

This section directs the Secretary of Agriculture, acting through the Farm Service Agency (FSA), to promulgate regulations not later than one year after enactment allowing distressed guaranteed FSA loans (i.e., loans made by private lenders with an FSA guarantee, typically for farm ownership or operating costs) to be refinanced into direct FSA loans if the borrower has unsuccessfully attempted to work with the lender, a reasonable chance of operational success exists, and other FSA criteria to protect taxpayer funds are met. The section requires that such refinancing have no impact on FSA guaranteed or direct loan subsidy rates; permits refinancing from one FSA program into another as appropriate; and subjects the resulting direct loans to existing maximum amount limits, including those in 7 U.S.C. 1925 ($600,000 for direct farm loans, inflation-adjusted since FY2019) and 7 U.S.C. 1943. (Thus, this provides a new pathway for financially troubled farm borrowers to shift from lender-serviced guaranteed loans to government-direct servicing.)

This section expresses the sense of Congress that access to credit is essential to the success of farmers and ranchers and that microloans, direct loans, and guaranteed loans provided by the Farm Service Agency should be fully funded to meet producer demand, help beginning farmers and ranchers, and support family farms.
