S. 90 — Historic Roadways Protection Act

This section prohibits the Secretary of the Interior, acting through the Director of the Bureau of Land Management (BLM), from obligating or expending federal funds during the applicable period to (1) finalize or implement a new travel management plan for any of 10 specified covered travel management areas in Utah (i.e., Henry Mountains and Fremont Gorge; Dinosaur (North); Book Cliffs (Vernal Field Office); Nine Mile Canyon (Vernal Field Office); San Rafael Swell; Nine Mile Canyon (Price Field Office); Book Cliffs (Moab Field Office); Dolores River; Trail Canyon; Paunsaugunt) or (2) implement four specified travel management plans in Utah (i.e., Indian Creek (Canyon Rims); San Rafael Desert; San Rafael Swell; Labyrinth/Gemini Bridges). The applicable period begins on the date of enactment and ends on the date the Secretary certifies to Congress that 22 specified R.S. 2477 cases—lawsuits by Utah counties and the state against the United States seeking confirmation of public-land road rights-of-way—have been adjudicated. (As background, R.S. 2477 granted rights-of-way across unreserved public lands to states and territories for highway construction prior to enactment of the Federal Land Policy and Management Act of 1976; BLM travel management plans designate allowable off-highway vehicle routes to minimize environmental damage, often conflicting with county road claims.)
